TERMS AND CONDITIONS 

All cakes made by Marion Gibbs and Maisy's Cakes are subject to the following terms and conditions.

General: These Term and conditions shall apply to the sale of the Goods by the seller to the buyer to the exclusion of all other terms and conditions referred, except where the seller has agreed to such variation by way of signature. By Ordering from Maisy’s Cakes you agree to be legally bound by these Terms and Conditions.

Product Information:  Each cake is individual to the customer and there will be slight differences in design. Cakes ordered from a picture or photos are for general illustration only and the cake will be produced with minor variations in appearance.

Orders:  We prefer three months’ notice for orders but we will accept short notice cake orders depending on the date required. Full payment must be made at the time of order for orders placed less than 2 weeks before delivery/collection. For orders beyond 2 weeks only the deposit needs to be paid and full payment two weeks before delivery/collection.

Deposit: We require a 50% non-refundable deposit on the placement of orders for all cakes, which is deducted from the final balance payment. 

Final balance payment: Final balance payment will need to be paid two weeks before delivery or collection.

Delivery: Cakes will be delivered and set up on the date required. We cannot be held liable for any damages to the cake we have delivered once we have delivered and set up the cake at the venue and received a signature for the safe receipt on our delivery note. Delivery timings cannot be guaranteed. Refunds will not be given for delays.

Collection: For cakes collected from us, again we cannot be held liable for any damages to the cake once they have left our kitchen. The collection vehicle should have a flat area and be clean. This is the buyer’s responsibility. The cakes are very fragile so we advise you to drive very slowly. 

Ingredients:  All our ingredients are of the highest quality. All cakes such as sponge, flavored and chocolate cakes are made to be eaten on the day of the celebration.

 

Allergies, dairy free, gluten free and the special dietary requirements: Please discuss any allergies or special dietary requirements with us before making payment. We offer various dietary options, every effort is taken to keep ingredients separate but our products are not suitable for certain allergies as our kitchen handles wheat and nuts.

Non – edible ingredients and decorations: Our products may contain non- edible ingredients or decoration such as plastic dowels and wooden dowels in tiered cakes or wires in some sugar flowers. These will be detailed on the notes and must be removed before serving.

Cancellations: Deposits are non - refundable and non - transferable. However, for wedding cakes full payment of the cake balance is required if cancellation is within two weeks of the wedding date. 50 % of the cake balance is required if cancellation is within 3-1 months.  You will be sent confirmation and information of any amounts due at the cancellation date, these amounts must be paid within 7 days of confirmation letter, any unpaid balances will go through the small claims court and customers will be responsible for costs and expenses incurred in this process.

Storage:  Cakes placed outside are liable to react to the temperature. In hot or humid weather there is the possibility of decorations melting or damage. Sugarpaste is not designed to be refrigerated it willl cause colours to run, the cake must be stored in a cool room temperature, the cake must be kept in the box (we will provide the box). Buttercream should be stored in the refrigerator, If the cake is kept in a sunny or warm room the buttercream will melt.

Alterations: If you have queries or you wish or need to make any changes to an order placed, contact us immediately. Make a booking and alterations must be confirmed in writing on the order form and via email.  We cannot guarantee that changes can be carried out dependent on the design and amount of notice given. We reserve the right to change the design at any point if circumstances beyond our control may affect the quality/design of the finished product for example the weather conditions or short notice bookings. 

Publication: We have the right to use any images of our cakes for publications at a later date.
